Tweak birth & death papers if transgender certificate given: High court
BENGALURU: The registrar of births and deaths is duty-bound to effect change in gender in birth or death certificates if applicants produce appropriate transgender certificates, until suitable amendments are made to the Registration of Births & Deaths Act, 1969, the Karnataka high court has ruled.
Applications accompanied by certificates issued under the Transgender Persons (Protection of Rights) Act-2019 should be accepted and processed for making relevant entries in the register of births and deaths and issuing the necessary birth or death certificate, Justice Suraj Govindaraj said.
The HC also directed the health officer of Mangaluru city corporation to process the application of the petitioner within four weeks
“The Law Commission, Govt of Karnataka, is requested to look into the Transgender Act and suggest appropriate amendments to the 1969 Act and the rules framed under it so as to give effect to the Transgender Act in its true letter and spirit, at the earliest,” the judge added.
