Parliament scuffle case: Delhi Police will take statements of injured MPs, Rahul Gandhi may be questioned
Parliament Winter Session 2024: A case was registered against Rahul Gandhi after the clash in Parliament. Police took action on the complaint of BJP MPs. Rahul Gandhi is accused of assault, in which two BJP MPs were injured. Police will question Rahul Gandhi and investigate CCTV footage. Congress rejected the allegations and accused BJP MPs of scuffle.

Krishna Kunal Singh, New Delhi: A case has been registered against Congress leader Rahul Gandhi in the case of clash in Parliament premises. According to sources, the police may record the statements of both the injured MPs and call Rahul Gandhi for questioning. Sources said the Delhi Police may write to the Parliament Secretariat seeking an inquiry into the CCTV footage of the area where the alleged incident took place. An official said senior police officials may also consider transferring the case from the local police to the Crime Branch.
A case was registered at the Parliament Street police station on Thursday under sections 115 (voluntarily causing hurt), 117 (intentionally causing grievous hurt), 125 (act endangering life or personal safety), 131 (use of criminal force), 351 (criminal intimidation) and 3(5) (common intention) of the Indian Penal Code. The case was registered just two hours after the BJP’s complaint against Rahul Gandhi. It alleged that he physically attacked during the clash in which two BJP MPs Pratap Chandra Sarangi and Mukesh Rajput were injured.
Police sources said Rahul Gandhi may be called for questioning and statements of other MPs who witnessed the incident may also be recorded. According to the source, a team of police officers can also record the statements of injured MPs Pratap Chandra Sarangi and Mukesh Rajput in the hospital. Their medical reports will also be examined.
Complaint lodged against Rahul
On Thursday, BJP MP Hemang Joshi, along with his party members Anurag Thakur and Bansuri Swaraj, reached Parliament Street Police Station and lodged a complaint. Congress has strongly rejected this claim. Congress has alleged that BJP MPs pushed and manhandled their national president Mallikarjun Kharge. Congress has also lodged a complaint related to this matter. A delegation of Congress MPs including Digvijay Singh, Mukul Wasnik, Rajiv Shukla and Pramod Tiwari went to the police station and lodged a complaint in this matter.
These sections have been imposed
- Section 115 of BNS (voluntarily causing hurt): In this, a term of imprisonment and a fine of 10 thousand is imposed or both are imposed. However, this is a bailable section.
- BNS section 117 (voluntarily causing grievous hurt): According to the law, this can result in a punishment of up to three years or fine or both.
- BNS section 125 (act endangering the life or personal safety of others): According to the law, this can result in a punishment of three months and a fine of Rs 2500, for causing hurt, a punishment of 6 months, while for causing more hurt, a punishment of three years and a fine of ten thousand rupees can be imposed.
- BNS section 131 (use of criminal force): This can result in a punishment of three months and a fine of one thousand rupees, or both. This is a bailable section.
- BNS section 351 (criminal intimidation): This can result in a punishment of two years or a fine or both.
