Madhya Pradesh High Court said, EWS should get 10 percent reservation in general quota only
On May 6, 2024, in the midst of the Lok Sabha elections, the Madhya Pradesh High Court gave a big decision regarding the 10 percent reservation to the economically weaker sections (EWS). Justice Vivek Agarwal of the Jabalpur Bench of the High Court, while dismissing the petitions filed by the upper caste people, said that the demand for 10 percent reservation for this category in the total posts under Article 16 (6) of the Constitution is wrong. He said in his decision that only 10 percent of the unreserved posts should be reserved for EWS.
This decision of the High Court is being considered an important decision, because it has become a general perception across the country that EWS is entitled to 10 percent reservation in the total posts. Even a notification was issued by the General Administration Department of the Madhya Pradesh Government on December 19, 2019, according to which there was a provision to give 10 percent of the total posts to EWS. Welcoming this decision of the High Court, G. Karunanidhi, General Secretary of All India Federation of OBC Employees Welfare Association, has said that this is a historic decision, which should be implemented at the all India level. In this regard, Karunanidhi has also written a letter to the Union Personnel Ministry, in which he has made this demand.
Success: OBCs will get 27 percent reservation in jobs and admissions in Punjab University
The matter is of Punjab University, where the reservation rights of backward classes have been going on for a long time. On May 28, 2024, the administration of this university, which comes under Chandigarh (Union Territory), has finally given a written assurance to give 27 percent reservation to the backward classes in jobs and admissions. However, this assurance was given by the OBC Federation, Krantikari Pendu Mazdoor Union, Mazdoor Mukti Morcha, DSO (Democratic Students Organization, Punjabi University, Patiala), AISA, CPI (ML), Yadav Samaj Sabha, Progressive Farmers Association, several student organizations of Punjab University and teachers, advocates, and members of civil society demonstrated continuously for 56 days from April 4, 2024 to May 28, 2024. This information was given by SFS President Sandeep Kumar.
Federation General Secretary Balwinder Singh Multani said that OBCs do not get any reservation in jobs in Punjab University. At the same time, only 5 percent reservation is given in admission. This matter has been going on for a long time. For this, an order was issued by the Ministry of Human Resource Development (presently Ministry of Education) on October 21, 2011. Apart from this, four years ago, this matter was brought to the notice of Bhagwanlal Sahni, the then chairman of the National Backward Classes Commission. He had also given clear instructions to the university administration in this matter that the backward classes should get reasonable 27 percent reservation in both jobs and admissions. But the upper caste people sitting in the university administration constantly ignored it.
According to Balwinder Singh Multani, on the call of OBC Federation, people along with SFS mobilized for this and continuously demonstrated in front of the university and now the university administration has given a written assurance that they will take legal action for this. He also told that the essence of the assurance given by the administration is that now OBCs will get 27 percent reservation in all the recruitments to be done in Punjab University. The same reservation will also be given to the students at the time of admission, which was only 5 percent earlier. Punjab’s share in both these reservations will be 12 percent.
On asking about Punjab’s share being 12 percent, Multani told that apart from Punjab, Haryana, Chandigarh (Union Territory) and Himachal have a share in Punjab University. 12 percent for Punjab means that out of 27 percent reservation for OBCs, 12 percent will be applicable for OBCs of Punjab province and the remaining 15 percent will be the share of other provinces. Balwinder Singh Multani said that earlier the university administration was thinking of limiting the 12 percent reservation given to OBCs in Punjab province as the basis for this in the university. But now it has agreed to give 27 percent reservation to OBCs.
Mamata government will challenge the decision of Kolkata High Court to reject OBC certificates in the Supreme Court
The issue of OBC reservation in West Bengal heated up amidst the Lok Sabha elections when the Kolkata High Court rejected the OBC certificates issued since 2010. Regarding this, Prime Minister and BJP leader Narendra Modi targeted the Mamata Banerjee government of the state. However, the state government has decided to challenge this matter in the Supreme Court. Let us tell you that the Kolkata High Court gave the above decision regarding the decision of the then Budhadev Bhattacharya government and then Mamata Banerjee government regarding giving reservation to Pasmanda castes. The High Court has said that the legal process was not followed for this.
