HC revokes bail of former MLA in Dalit engr assault case, asks him to surrender in 30 days
Jaipur: Rajasthan High Court has revoked the bail granted to former Congress MLA Girraj Singh Malinga in connection with a case lodged against him for assaulting an assistant engineer (AEN) and a junior engineer (JEN) at the Bari electricity department office in Dholpur.
The single bench of Justice Farzand Ali cancelled the bail while hearing a petition filed by AEN Harshadhipati, the petitioner’s counsel AK Jain said. The court directed Malinga to surrender within 30 days.
Malinga had been granted bail by the high court two years ago due to the Covid pandemic. However, during the hearing of Harshadhipati’s petition, the court determined that Malinga had misused his bail privileges.
The petitioner argued that Malinga had taken undue advantage of the bail granted to him by the court, citing the Covid pandemic as an excuse. His advocate Jain argued that immediately after securing bail, Malinga had organized a procession and threatened the victim and witnesses in the case. Based on these grounds, the petitioner sought the cancellation of the accused’s bail application.
The assault on Harshadhipati and JEN Nitin Gulati took place at the Bari electricity office in Dholpur on March 28, 2022. Following the incident, Harshadhipati filed a case against Malinga and others on March 29, alleging assault, obstruction of state work, and violations under the SC-ST Act. Five people were arrested in connection with the case.
The incident led to the transfer of the then Dholpur SP Shivraj Meena and sparked widespread protests among employees of the electricity department across the state, demanding Malinga’s arrest. In response, Malinga, accompanied by the then MLA Rajendra Gudha, met with the then chief minister Ashok Gehlot at the CM house before surrendering.
Malinga surrendered before the then Jaipur Police Commissioner Anand Srivastava on May 11 and was presented in the SC-ST court on May 12, where he was remanded to 15 days of judicial custody. Subsequently, Malinga filed a bail application in the high court, which ordered his release on bail on May 17, 2022.
Malinga had joined BJP and fought the 2013 assembly elections from Bari constituency; however, he was defeated by Bahujan Samaj Party (BSP) candidate Jaswant Singh Gurjar. The assault on a Dalit govt employee had become a major poll issue in the area.
