Gujarat: Bail of accused rejected in Dalit youth beating case, know the whole incident
Junagadh: A police complaint has been filed against Gondal MLA’s son Ganesh Jadeja and nine others on charges of kidnapping and murder of Junagadh’s Dalit youth Sanjay Solanki and caste-based insult. In this case, Junagadh police arrested three accused from Jasdan on June 3 and other accused including main accused Ganesh Jadeja were arrested on June 6. Bail plea of ??accused rejected Junagadh police produced all the accused in Junagadh court and sought remand. But the court rejected the remand and ordered all the accused including Ganesh Jadeja to be sent to judicial custody. After this, all the accused including Ganesh Jadeja applied for bail on June 21. After the hearing of which was completed, Junagadh court has rejected the bail plea of ??all the accused.
What was the whole matter?
On the midnight of May 31, Sanjay Solanki had a clash with Ganesh Jadeja and some of his companions over driving. Then Ganesh Jadeja and his associates kidnapped Sanjay Solanki and kept him hostage at an unknown place near Gondal. Along with threatening to kill him, he also used caste-specific insults. Dalit youth Sanjay Solanki had lodged a complaint with the police. Then Junagadh police arrested the first three accused on June 3 and on June 6, the main accused Ganesh Jadeja and other accused were taken on remand in the court.
Hearing in Gondal MLA Junagadh Court: The Junagadh court rejected the remand of all the accused produced in the court by the police on remand and ordered all the accused to be sent to Junagadh District Jail in judicial custody. After this, the main accused Ganesh Jadeja along with other accused applied for bail in Junagadh District Court on June 21. The arguments of the defense and prosecution lawyers continued till evening. Then the Junagadh court gave its verdict on June 25 whether the accused should be granted bail or not. Now today the Junagadh court has rejected the bail application of all the accused. Advocate Rajesh Buch of Junagadh on behalf of accused Ganesh Jadeja and advocate Sanjay Pandya on behalf of prosecutor Sanjay Solanki. In which the prosecution lawyer filed an objection petition and opposed the granting of bail to the accused and said that the accused have a lot of political power and they are also financially capable, keeping in mind that if the accused are granted bail, they will tamper with the evidence after being released on bail and this can also harm the prosecution.
The bail application of the main accused Ganesh Jadeja and other accused has been rejected by the Junagadh District Court today. Now to get bail in the entire case, the accused will have to file an application in the state High Court. In the case, a complaint of caste-based insult along with assault, kidnapping and murder has also been filed. Whether the state High Court grants bail to the accused or not can also become a matter of great debate. At present there is no clarification on whether the accused party will file a bail petition in the state High Court or not.
