Big change in law from July 1, sections of rape, murder and robbery will change
Law New Rules: Now BNS will replace IPC and BNSS will replace CRPC. Training was given to the head constables of all the police stations regarding the new laws coming into force from July 1.
Law New Rules: Three new laws will come into force from July 1. Indian Penal Code (IPC) will now be replaced by Indian Justice Code (BNS). Indian Civil Security Code (BNSS) will replace Indian Criminal Procedure Code (CRPC) and Indian Evidence Act (IEA) will be replaced by Indian Evidence Act (BSA). Sections of rape, murder and robbery will change in the new laws.
Fine amount increased in 83 crimes
In UP’s Agra Commissionerate, all constables and head constables were trained in the workshop by Joint Director Prosecution Vinod Kumar Mishra, SPO Brijmohan Singh and PO Rajesh Kumar, Ritesh Kumar. He told that there were 23 chapters and 511 sections in IPC. BNS has 20 chapters and 358 sections, in which the period of imprisonment has been increased in 33 sections. The fine amount has been increased in 83 crimes. 9 new sections have been added.
According to media reports, he told that section 323 of IPC will now be called 115 (2). Acid attack 326A will be replaced by 124 (1) and rape section 376 will be replaced by section 64, murder section 302 will be replaced by section 103, theft section 378 will be replaced by 303 (1). Cases will now be registered under section 310 (2) instead of section 395 of robbery, fraud section 318 (4) will be implemented instead of 420.
Forensic investigation is mandatory in crimes punishable with more than seven years
BNSS is being implemented in place of CRPC. CRPC had 37 chapters and 484 sections. BNSS will have 39 chapters and 531 sections. FIR under section 154 will now be under section 173. FIR can also be lodged through zero FIR and electronic medium. Forensic investigation will be necessary in crimes above seven years of age. Serious cases can be investigated by ACP and DSP. POCSO investigation will have to be completed in 2 months. Permission will have to be taken from ACP for arrest in crimes with punishment less than 3 years.
Photos, videos, messages will become important evidence
Indian Evidence Act (BSA) 2023 will replace Indian Evidence Act (IEA) 1872. IEA had 11 chapters and 167 sections. BSA has 12 chapters and 170 sections. Section 32 of the statement before death will now be known as Section 26. Photos, videos, messages will also become important evidence in BSA. Also, testimony of doctors, police and other witnesses will be possible through video conferencing. In the new law, emphasis has been laid on justice instead of punishment.
