Nov 14: HC lists final hearing on hosp facilities for transgenders
Jodhpur: Listing a PIL pertaining to separate facilities for the transgender community in govt hospitals, the high court has expressed displeasure over the laxity of state govt in filing reply in the court.
The court had sought the reply on Sept 19 but in absence of the reply from the state on the next four successive proceedings, the court has now posted the matter for final disposal on Nov 14.
The petition, filed by Sambhali Trust, has sought directions to provide and facilitate separate wards and separate toilets for the transgender community in the govt hospitals in the state.
Arguing in the court, trust’s counsel Shivani Singh submitted that there is already a central legislation for protecting the rights of transgender community in public service while citing the section 15 of the Transgender Act, 2019 and Rule 10(5) of Transgender Rules, 2020.
She said that while a state like Maharashtra has already set up wards in its hospitals for the transgender community, Rajasthan has not taken any step in this direction.
“In Rajasthan, the transgender community is deprived of welfare facilities. There are neither separate wards for the community in the state hospitals nor are there doctors for them,” she argued.
During the hearing, the govt counsel sought adjournment again and granting her prayer, the division bench of Justice Madan Mohan Vyas and Justice Shree Chandrashekhar has posted the matter for final disposal on Nov 14.
The court had issued notices to the state govt through the secretaries of medical & health services and social justice & empowerment as well as director of medical & health services and chairman of the Transgender Welfare Board.
